EXPERIENCED LAWYER HELPS DRIVERS AT RISK OF MAJOR PENALTIES

The severity of each traffic offense is shown by the number of points that will be added to the driver’s license if he is convicted of the crime. A driver who accrues 12 points on his license within a three-year timespan will have his license suspended. After adding only six points to his license in a three-year span, he will have to pay a surcharge.

In my criminal defense practice, I represent people fighting traffic tickets for offenses of all point levels. Some of the high-point offenses for which I offer skilled defense include:

  • Leaving the scene of an accident — A hit-and-run driver can be charged with this crime. If the accident caused personal injury or death, it is an eight-point offense. A driver found guilty may also pay thousands of dollars in fines and spend time in jail. Fleeing the scene of an accident that did not cause injury is only a two-point offense.
  • Reckless driving — Reckless driving involves the willful or wanton disregard of the rights or safety of others. One charge of reckless driving counts for five points, and a conviction for a first offense is punishable by 60 days in jail and a fine.
  • Improper passing of a school bus — Ignoring the Stop sign attached to a stopped school bus creates potentially dangerous circumstances for children and other people who may enter the roadway. This offense counts for five points.
  • Racing — Racing on the highway poses a serious risk for any driver or pedestrian along the chosen “racecourse.” A conviction will add five points to the driver’s license.
  • Tailgating — Tailgating, or following too closely, is also a five-point offense.
  • Speeding — Speed limits exist to keep people safe on the road. Exceeding the speed limit by 30 miles per hour or more is a five-point offense. Two to four points can be imposed for going less than 30 miles per hour above the speed limit.

A single traffic violation conviction can cause your auto insurance rate to increase dramatically. Two or more convictions can force you off the road under the terms of a license suspension. I will aim to help you avoid any convictions that could jeopardize your rights.

DETERMINED DRIVER DEFENSE LAWYER CHALLENGES THE PROSECUTION’S EVIDENCE

In my practice, I’ve found that an overzealous police officer may see a traffic violation where one doesn’t actually exist, and I know that some drivers who committed an offense may have a legally defensible reason for doing so. Whenever possible and in my client’s best interest, I will negotiate with the prosecutor and try to have a high-point charge reduced to a low-point charge. If this is not an option, I will fight the charges at trial, using evidence relevant to the case to seek a favorable outcome for my client. Dashcam footage, witness statements and the police report may provide evidence to exonerate a driver.
